1. Where appropriate, for safe use, the warnings provided for in Article 11.2 shall specify the appropriate restrictions relating to the user, in accordance with Annex V, Part A. For the categories of toys listed in Annex V, Part B, the warnings set out in that Part shall be used. The warnings set out in points 2 to 5 of Annex V, Part B shall be used as worded therein. Toys shall not bear any of the specific warnings referred to in paragraph 1 if they are in contradiction with their intended use, determined by virtue of their function, size and characteristics.

2. The manufacturer shall indicate the warnings in a clearly visible, legible, easily understandable and precise manner on the toy, on a label attached to it or on the packaging and, where appropriate, in the instructions for use accompanying the toy. Small toys sold without packaging shall bear appropriate warnings placed directly on the toy. The warnings shall be preceded by the word "Warning" or "Warnings", as appropriate. Warnings that determine the decision to purchase the toy, such as those specifying the minimum and maximum ages of users, as well as other applicable warnings set out in Annex V, shall appear on the packaging intended for the consumer or, if not, shall be clearly visible to the consumer before purchase, including when the purchase is made "on line".

3. In accordance with Article 5.7, warnings and safety instructions shall be written at least in Spanish.

ANNEX V

Warnings

Part A

General warnings

The restrictions on the user referred to in Article 12.1 shall include at least the minimum or maximum age of the users of the toys and, where applicable, their maximum or minimum capacity and weight, as well as the need to ensure that the toy is used only under adult supervision.

Part B

Specific warnings and indications of precautions to be taken when using certain categories of toys.

1. Toys not intended for children under thirty-six months.

Toys that may be dangerous for children under thirty-six months shall bear a warning, for example, “Not suitable for children under 36 months”, “Not suitable for children under three years”.

These warnings shall be accompanied by a brief indication, which may appear in the instructions for use, of the specific hazard for which the warning applies.

This point shall not apply to toys which are clearly, by their functions, dimensions, characteristics, properties or other obvious elements, not suitable for use by children under thirty-six months.

2. Activity toys.

Activity toys shall bear the warning: “For domestic use only”.

Activity toys attached to a crossbar, as well as other activity toys, where appropriate, shall be accompanied by instructions for use highlighting the need for periodic checks and inspections of their most important parts (suspensions, fastenings, floor fixings, etc.) and specifying that failure to carry out such checks could result in the toy presenting a risk of falling or tipping over. Instructions must also be provided on the correct way to assemble them, indicating the parts that may be dangerous if assembled incorrectly. The appropriate surface must be specifically indicated.

3. Functional toys.

Functional toys must bear the warning: "Use under the direct supervision of an adult."

In addition, they must be accompanied by instructions for use indicating the precautions that the user must take, warning him that failure to take these precautions will expose him to the dangers - which must be specified - inherent to the device or product of which the toy is a scale model or imitation. It must also be indicated that the toy must be kept out of the reach of children under a certain age, an age to be decided by the manufacturer.

4. Chemical toys.

Without prejudice to the application of the provisions laid down in applicable Community legislation on the classification, packaging and labelling of certain substances or mixtures, the instructions for use of toys containing substances or mixtures that are dangerous by nature shall warn of their dangerousness and indicate the precautions to be taken by users to avoid the dangers they entail, which shall be specified concisely according to the type of toy. The first aid to be administered in the event of serious accidents that may result from the use of such toys shall also be mentioned. It shall also indicate that the toy must be kept out of the reach of children under a certain age, an age to be decided by the manufacturer. In addition to the indications mentioned in the previous paragraph, chemical toys shall bear the following warning on their packaging: “Not suitable for children under (*) years of age. Use under adult supervision.”

In particular, chemical toys are considered to be: chemistry sets, plastic embedding kits, mini-workshops for pottery, enamelling or photography and similar toys that involve a chemical reaction or similar alteration of the substance during use.

5. Roller skates, inline skates, skateboards, scooters and children's toy bicycles.

When these products are sold as toys, they must bear the following warning: "Protective equipment should be used. Do not use in areas with traffic."

In addition, the instructions for use must remind that the toy must be used with caution, since it requires a great deal of skill, in order to avoid falls or collisions that cause injury to the user or other people. Some indication of the recommended protective equipment (helmets, gloves, knee pads, elbow pads, etc.) must also be given.

6. Toys intended for use in water.

Toys intended for use in water shall bear the following warning:

“Use only in water where child can stand and under adult supervision.”

7. Toys in food.

Toys distributed in food or mixed with food shall bear the following warning: “Contains a toy. Adult supervision recommended.”

8. Toys imitating protective masks and helmets.

Toys imitating protective masks and helmets shall bear the following warning: “This toy offers no protection.”

9. Toys intended to be suspended above a crib, playpen or stroller by means of cords, strings, elastic or straps.

Toys intended to be suspended above a cot, playpen or pram by means of cords, strings, elastics or straps shall be accompanied on the packaging by the following warning which shall be permanently marked on the toy: "To avoid possible injury from strangulation, this toy must be removed when the child starts to try to pull himself up using his hands and knees."

10. Packaging for olfactory board games, cosmetic kits and taste games.

Packaging for olfactory board games, cosmetic kits and taste games containing fragrances referred to in points 41 to 55 of the list in Annex II, Part III, point 11, first paragraph, and fragrances referred to in points 1 to 11 of the list in the third paragraph of that point shall bear the following warning: "Contains fragrances which may cause allergies."
